When placing an order on www.kyraminerals.com, you accept all general terms and conditions of business of Kyra mineral cosmetics (hereinafter also “KYRA”) of the company Qulavit d.o.o. (General Terms and Conditions). The General Terms and Conditions between you and KYRA apply whenever you review, use or place an order on the website www.kyraminerals.com (website). By viewing or using this website, you acknowledge that you have read these terms, understand, agree to and fully accept them. The General Terms and Conditions contain important information for all KYRA customers, so please read them carefully.

KYRA strives to ensure the accuracy and up-to-dateness of the information on the website. At the same time, it reserves the right to change the content of the website or stop updating it at any time, without any prior notice, and assumes no responsibility for rebuilding the website. The owner of the website may change the products, prices or programs described on this website at any time and without any notice. Before using the data from the website, check the accuracy of the information in the company. Use of the website owner's trademark is permitted only with the prior permission of the website owner. All texts, images and other content displayed on the website have been selected and edited by the owner of the website and are merely informative data collected for the purpose of presenting the company Kyra mineral cosmetics owned by Qulavit d.o.o.

The general operating conditions of the Kyra mineral cosmetics online store have been compiled in accordance with the Consumer Protection Act (ZVPot), based on the recommendations of the Chamber of Commerce and Industry and international codes for e-commerce.

The Kyra mineral cosmetics online store (hereinafter referred to as the "online store") is operated by Qulavit d.o.o. (hereinafter referred to as "providers"). The General Terms and Conditions deal with operations, user rights and the business relationship between the provider and the customer.


AVAILABILITY OF INFORMATION

The provider undertakes to always provide the buyer with the following information:

  • company identity (company name and registered office, register number),
  • contact details that enable the user to communicate quickly and efficiently (e-mail, telephone),
  • essential characteristics of the products,
  • product availability (any product offered on the website should be available within a reasonable time),
  • conditions of delivery of the product (method, place and time of delivery),
  • all prices must be clearly and unambiguously set and it must be clearly shown whether they include taxes and transport costs,
  • method of payment and delivery,
  • the time validity of the tender,
  • the period within which it is still possible to withdraw from the contract and the conditions for withdrawal; also about if and how much it costs the customer to return the product,
  • an explanation of the complaint procedure, including all details of the contact person or customer service.


PRODUCT OFFER

Due to the nature of online business, the offer of products in the online store changes and updates frequently and quickly.

Purchased products will be delivered to any address in Slovenia or abroad. Delivery is provided by Post Slovenia. It is also possible to pick up the packages in person at the company's registered office. The delivered goods will be sent by the provider within 3 working days, if the goods are not in stock, the user is informed before the completion of the purchase, as well as the estimated delivery time. If the customer decides to buy two products, he must always take into account the delivery time of the product, which is the longest. Every product on offer in the online store is available within a reasonable time.

If the product on offer is no longer available or the delivery time is longer than stated, we will notify you in advance via e-mail.


METHOD OF PAYMENT

The online store allows the following payment methods:

  • payment by cash on delivery
  • payment on bank account according to the pro forma invoice sent to the customer's e-mail address,
  • payment via Paypal


PRICES

The online price is valid for all users of the online store. All prices in the online store are listed in EUR and include 22% VAT. Prices in the online store do not include shipping costs. Prices are valid at the time of placing the order and do not have a predetermined validity. In the event that the price of the item changes during the processing of the order, the provider will allow the buyer to withdraw from the purchase, and at the same time offer the buyer a solution that will go to mutual satisfaction. The purchase contract between the bidder and the buyer is concluded at the moment when the bidder confirms the order (the buyer receives an electronic message about the status Order completed). From this moment on, all prices and other conditions are fixed and apply to both the provider and the buyer.

Promotions and discounts are marked online and are valid for selected products for a certain period. Promotions and discounts are excluded and do not add up.


PURCHASE PROCEDURE

The buyer can order the desired goods by phone, e-mail or the Internet through the online store. You can send us corrections or additions to the order by e-mail or let us know by phone.

Data on the concluded contract or on the placed order are stored at the company Qulavit d.o.o., the buyer can access the contract in a preliminary inquiry via e-mail. Before the final award of the order, the consumer can check the correctness of the order, where a complete overview of the order is possible, including the quantity and price, and the possibility of correcting any errors. Only by confirming this choice will the order actually be awarded. After confirming the purchase, the buyer can arrange the correction of the order by notification by e-mail or telephone, but only until the moment when the goods are shipped.



Steps in the purchase process:


STEP 1 - ADDING PRODUCTS TO THE SHOPPING CART

Add the product you want to buy to the cart by clicking on the appropriate button ("Add to cart"). The products are sorted by categories, you can also search for them using the search engine. For more detailed information about the selected product, click on the product name. You can add any number of products to the cart. Once you've finished adding, you can continue shopping or complete your purchase later. In the first case, the products in the cart will be saved for later purchase.


STEP 2 - (optional) ENTER THE PROMOTIONAL CODE

Clicking on the cart and then “Show cart” redirects you to the cart. You can also remove the products in the basket by clicking the X button or change the quantity with the +/- buttons.

If you have a "promotional code" for a discount, you can enter it in the "Coupon code" field and reduce the amount of your order. Promotional codes can be obtained in several ways, through advertising campaigns on Facebook and Instagram profiles and through the website www.kyraminerals.com

When you are ready to order, click on "Continue to checkout".


STEP 3 - CHOOSING PAYMENT METHOD AND DELIVERY (registration, entering address for payment and delivery)

Enter your delivery details. If you want to receive the ordered products to another address (eg to work) or send them to someone as a gift, click on "Delivery to another address" in the delivery field and then enter the required information. In this case, the invoice will be sent to the customer and the products to the addressee.


STEP 4 - PAYMENT

Select the desired payment method and complete the purchase. Before clicking the "Submit Order" button to complete your purchase, double-check that the amount of products you ordered is correct. Also check the delivery address. In this step, also select the appropriate payment method and click on "Place an order". The page redirects you according to the selected payment method, where you enter your payment information.

You will receive a confirmation of a successful order to your e - mail address.


CANCEL ORDER

Order cancellation is possible within 2 hours after placing the order by e-mail or telephone. In case of cancellation by e-mail to info@kyraminerals.com, the buyer informs the bidder that he wants to cancel the order and in the message he must state the following information: in the subject of the message: Cancellation of the order; in the content of the message: a) order number b) name and surname of the buyer and c) address of the buyer.


RIGHT TO WITHDRAW FROM PURCHASE, RETURN OF GOODS

The consumer has the right to notify the seller within 14 days of receiving the ordered products that he is withdrawing from the sales contract, without having to state the reason for such a decision. Withdrawal from the contract is announced by the buyer to the e - mail address of the seller: info@kyraminerals.com 

The only cost borne by the buyer due to withdrawal from the contract is the cost of returning the products (the cost of postage is paid by the buyer).


  • The product must be returned to the seller no later than 14 days after the notice of withdrawal is sent.
  • If you withdraw from the contract as a consumer, our company will refund all payments made no later than 15 working days after receipt of the notice of withdrawal.
  • We will withhold the refund of payments received until we receive the returned goods or until you provide us with proof that you have sent the goods back.
  • In case of payment by credit card or PayPal, we will return the received payments by the same means of payment.
  • All payments made after collection are returned by transfer to your bank account. The bank account number must be entered in the complaint form.
  • Purchased products must be returned to the seller undamaged, in the original packaging, not used and in the same quantity.
  • A copy of the invoice must be attached.
  • As a customer, you bear the risk of losing, damaging or destroying the product you want to return or replace, unless it was your fault. Already used products cannot be returned.
  • When withdrawing from a contract where a bonus, discount code or promotional code has been used, these funds are considered as a discount and are not returned to the buyer. Only the amount paid is returned to the buyer.
  • When returning the products, you must enclose a copy of the invoice and a completed return form, which can be downloaded here.

  • Use a delivery service that allows you to track shipments and prepare the goods for transport accordingly.
  • Shipping costs are always borne by the sender. We do not accept redemption shipments!
  • Complaints will not be considered for products that found to have been damaged due to improper or inappropriate use or handling. If you want to pick up such a product again after rejecting the complaint, we will send it to you and charge the costs associated with the delivery of such a product, but you can pick up such a product at our address.

The possibility of withdrawing from the contract in accordance with ZVPot does NOT apply to legal entities.


ACTUAL ERROR

The error is real when:

  • the product does not have the characteristics necessary for its normal use,
  • the product does not have the characteristics necessary for the specific use for which the buyer buys it, but which was known to the seller or should have been known to him,
  • the seller has delivered a product which does not conform to the sample or model, unless the sample or model was shown only for the purpose of notification.

How is the suitability of an item checked?

It is checked with another, faultless item of the same type, as well as with the manufacturer's statements or statements on the item itself.


How does a real mistake materialize?

The buyer may exercise his rights arising from a material defect if he notifies the seller of the defect within two months from the day on which the defect was discovered. The buyer must describe the defect in detail in the defect notice and allow the seller to inspect the thing.

The seller is not liable for material defects in the goods that appear after two years have elapsed since the thing was delivered. A defect in things shall be deemed to have existed at the time of extradition if it occurs within six months of extradition.

The consumer, who has correctly informed the seller of the defect, has the right to require the seller to:

  • rectify the defect in the goods or refund part of the amount paid in proportion to the defect, or
  • replace the defective goods with a new faultless one or
  • returns the amount paid.

DELIVERY

The bidder will deliver the ordered products to the buyer within the agreed time. The contractual partner for the delivery of shipments is Post Slovenia. The cost of delivery for Slovenia is 4.50 EUR. In the case of sending products to European Union countries, the delivery cost is EUR 7,50. For faster delivery or delivery outside the country of Slovenia, it is necessary to agree by phone or by email. In the case of express delivery, the price list of the delivery service that took over the shipment is used for the cost of postage.

Delivery is free for orders up to EUR 60.


SECURITY

The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data and payments. The website you are currently on has a SSL security certificate installed, which encrypts data between the page and visitors and allows secure data transfer. All your personal data that you enter on this page is encrypted at the time of transfer and is unreadable in the event of unauthorized access. Payment transactions via Paypal that take place outside our online domain are also protected with the highest level of encryption. The page is protected and secure if you see the lock icon at the top of the browser next to the domain name.


PROTECTION OF PERSONAL DATA

The provider undertakes to permanently protect all personal data of the user. The provider will use personal data exclusively for the purpose of fulfilling the order (sending information material, offers, invoices) and other necessary communication.

Under no circumstances will the user's data be passed on to unauthorized persons. The user is also responsible for the protection of personal data by ensuring the security of his username and password.


COMMUNICATION

The provider will contact the user via means of distance communication only if the user does not explicitly object.

Advertising emails will include the following:

  • will be clearly and unambiguously marked as advertising messages,
  • the consignor will be clearly identified,
  • various campaigns, promotions and other marketing techniques will be marked as such. The conditions for participation in them will also be clearly defined,
  • the method of unsubscribing from receiving advertising messages will be clearly presented,
  • the provider's wish not to receive advertising messages will be explicitly respected by the provider.


We reserve the right to inform you of the status of your order at the entered telephone number or e-mail address. In the event that you do not pick up the order for more than 5 days, we reserve the right to call and notice as a reminder to pick up the items.


LEGAL NOTICE

The Kyra online store and all data on it, product images and video elements on the website are protected by the Copyright Act and may not be reproduced or used without prior written permission. The Kyra mineral cosmetics brand and logo are owned by Qulavit d.o.o.

COMPLAINTS AND DISPUTES

The provider complies with applicable consumer protection legislation. The provider makes every effort to fulfill its duty to establish an effective complaint handling system and to designate a person with whom the customer can contact by phone or e-mail in the event of problems. The complaint is submitted via e-mail: info@kyraminerals.com

The appeal procedure is confidential.

The bidder will acknowledge receipt of the complaint within five working days, inform the buyer how long it will take to process it, and keep him informed of the progress of the procedure. The provider is aware that the essential feature of a consumer dispute, at least as far as judicial settlement is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating a dispute in court. Therefore, the provider strives to the best of its ability to resolve any disputes amicably.


OUT-OF-COURT RESOLUTION OF CONSUMER DISPUTES

In accordance with legal norms, we do not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-Court Settlement of Consumer Disputes Act.

That regulation derives from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) no. Regulation (EC) No 524/2013 of the European Parliament and of the Council on the online settlement of consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22 / EC.

ADDITIONAL EXPLANATIONS REGARDING THE PURCHASE

According to the Code of Obligations, the buyer is obliged to take over the ordered package and pay the ransom. If the buyer does not pick up the ordered goods sent by cash on delivery and is returned to the company's address after the delivery service has expired, this is NOT considered a withdrawal from the contract, as the latter is still validly concluded and unilateral unannounced withdrawal of the buyer from the contract. If the buyer does not take over the package, he causes financial damage to the company and is thus responsible for paying the costs of shipping and sending / returning products to the company, for which the seller will issue an invoice, which the buyer is obliged to pay because he did not terminate the contract. In case of non-payment of the invoice, the matter is settled with a claim. Receivables are regulated by an external company. In the case of fraudulent orders, we will hand over the IP address for further treatment as abuse. Non-collection costs amount to EUR 25.00 excluding VAT and include administrative costs, packaging, shipping and return costs.


PRIVACY PROTECTION

 

GENERAL

The seller undertakes to protect the confidentiality of personal data and the privacy of users of the online store. The collected personal data will be used by the seller exclusively for the provision of the services he offers. The seller respects the confidentiality of personal data and the privacy of users of the online store, and will do everything necessary to protect them from any violations and abuse. The seller pays great care and attention to the personal data of users, as he is aware of the sensitive nature of this area.


USE OF PERSONAL DATA

The Seller collects, manages, processes and stores the following user data for the purposes of providing the services it offers:

  • name and surname
  • shipping address
  • company or name of the legal entity (if the user is a legal entity)
  • tax number of the legal entity (if the user is a legal entity)
  • e-mail address (username)
  • password in encrypted form
  • contact telephone number
  • country of residence
  • other data that the user enters voluntarily in the forms in the online store
  • other data that the user voluntarily adds later in his profile


The seller is not responsible for the correctness, completeness and up-to-dateness of the data entered by users.


COOKIES AND IP ADDRESSES

The seller assigns a cookie to each user at the beginning of each use of the online store to identify, monitor the shopping cart and ensure traceability (i.e. "cookie"). The seller may also store some persistent cookies on the user's personal computer, such as the user's identification number in encrypted form for identification on the next visit to the online store or evaluation of items, with which the user knows which items have already been evaluated, and indirectly Google Analytics external cookies used to analyze website visits. The seller may use this data in an anonymised summary form for statistical analysis purposes. For the purposes of ensuring online security, the seller also collects IP addresses from which users access the online store.


DECLARATION ON PROTECTION OF CONFIDENTIALITY OF PERSONAL DATA AND PRIVACY OF USERS

In accordance with the regulations governing the protection of personal data, the seller is obliged to protect the personal data of users of his online store. Under no circumstances will the seller provide personal or personal information without the express permission of the user and other user data to a third party or will not allow a third party to inspect personal or other information of the user, unless required by the state authorities, if such an obligation is provided by law, or in good faith that such action is necessary for proceedings before courts or other state authorities and to protect and pursue the legitimate interests of the seller.


All personal and other data that the user will provide when logging in to the online store, as well as when ordering the purchase of products, including the content of orders, will be protected in accordance with the regulations governing the protection of personal data. Seller will not use this information for any purpose that would harm the user or any other person involved. The seller will not use user data to send promotional e - mails or other unsolicited promotional material, except to send those promotional notices to which the user subscribes or with which he will agree. The seller may use the data in an anonymised summary form for statistical analysis purposes. The confidentiality of personal and other user data will not be violated in any form.


The seller will entrust the delivery service (Post Slovenia, DPD, GLS, etc.) only with the necessary data for delivery of products purchased in the online store (data on the recipient and delivery address). The seller will contact the user via e-mail if this is necessary to make a purchase in the online store, and via the contact telephone number only if it is in the process of registration or there were problems with the purchase in the online store.


IMPLEMENTATION OF PRIVACY POLICY

All full-time or part-time employees of the seller who have access to personal and other user data are aware of the duty to protect personal and other data and are obliged to comply with these provisions on protecting the confidentiality of personal data and privacy of online store users. The duty to protect personal and other data is valid indefinitely, even after the termination of the relationship with the seller.

Registered users can stop using the online store at any time and can cancel their registration. They do this by notifying the seller in writing of the cancellation of the registration. Before submitting the statement on the cancellation of registration, the user must settle all outstanding obligations arising from purchases made in the online store. The seller will protect the confidentiality of personal data and the privacy of users of the online store under this privacy policy even in the event of cancellation of registration.

DELIVERY AND METHOD OF PAYMENT

  • Payment by proforma invoice, which you receive at your e-mail address.

DELIVERY

The purchased products will be delivered to any address in Slovenia and to selected EU countries. Delivery is provided by Post Slovenia. In the case of sending products to the countries of the European Union, the price list of the delivery service that took over the shipment is used to calculate the commission. For faster delivery or delivery outside the country of Slovenia, it is necessary to agree by phone or by email. For goods in stock, the delivery time is from 3 to 5 working days after receiving a bank transfer or payment by card, but if the goods are not in stock, the user is notified before the purchase, as well as the estimated or the estimated time for delivery.

 

  • No delivery during weekends and holidays.
  • Packages are sent on weekdays (Monday to Friday, except during holidays). Orders placed on Saturdays and Sundays will be processed on the first following business day.
  • The bidder will deliver the goods within the agreed time.
  • Because the delivery service delivers items in the morning, you can also choose to deliver to any other name or address. If you are not at the intended place (company, office, etc.) at the time of delivery, the courier will leave a message with instructions for later collection.
  • If you do not receive the goods within a few days of dispatch, please notify us immediately by e-mail: info@kyraminerals.com


Delivery costs

The amount of postage is 4.50 EUR in Slovenia and 7.50 EUR in EU countries.

 

Delivery damage

Complaints of products damaged during transport are considered within 7 days of receipt of the shipment. Subsequent complaints cannot be considered.

Please send us an e-mail to info@kyraminerals.com, with as much information as possible about the damaged work, so that we can send you a new one as soon as possible and fix the problem with the delivery service. It is also necessary to send a picture of the damaged item.


RETURN OF GOODS AND COMPLAINTS

1. In case you would like to return the ordered products, you have the right, in accordance with the Consumer Protection Act, to send us the e-mail address on info@kyraminerals.com with a form for withdrawal from the contract within 14 days of receiving the goods in which you indicate that you are withdrawing from the contract. Don't forget to tell us the order number, the product you want to return.

2. In the event that you return the product without prior notice, we reserve the right to reject your request to return the product.

3. Purchased products must be returned undamaged, in the original packaging, unused and in the same quantity. Already used products cannot be returned.

4. If you received a free gift or free product when ordering and would like to return the entire order, you must return the free gift or free product along with the rest of the order. If you return the entire order, but want to keep the free gift or free product, we will deduct the value of the free gift or free product from the rest of your order.

5. Please pack the products securely before shipping. A copy of the invoice and a completed return form must be attached, which you can download here.
